A coalition of tenants and neighborhood residents have apparently lost their legal battle to stop Rochester Management from replacing the Cobbs Hill Village senior-resident apartment complex with new apartments for seniors.
On May 2, Supreme Court Justice William Taylor dismissed two separate suits against Rochester Management, the City of Rochester, the City Planning Commission, and the city’s manager of zoning. One suit challenged the environmental review; the other argued that the city didn’t properly comply with procedures for reviewing and approving plans for the site. Taylor denied all of the claims in both suits.
Alan Knauf, the attorney who represented the coalition suing Rochester Management, said on Monday that an appeal is likely.
Rochester Management plans to demolish the 60-unit apartment complex on Norris Drive next to Cobbs Hill Park and build 104 new units. Many of the opponents wanted Rochester Management to repair the existing units, arguing that the new complex reduces the number of units for very low-income people. Others wanted the property to be returned to parkland.
In a statement on Monday, Rochester Management officials said they expect construction to begin in the fall.
